These General Terms and Conditions (Terms) govern the use of visiv. Please take a moment to read them – we have kept them as simple as possible.
1. Who we are and what these Terms apply to
visiv is a brand of nnexd GmbH, Halden 28, 8604 Volketswil, Switzerland (“we”).
These Terms apply to the visiv app, to the website visiv.tv, to the visiv account and to all visiv subscriptions.
By creating an account, using visiv or taking out a subscription, you accept these Terms. For purchases, the terms of the store in which you buy also apply.
2. visiv is a player – without content of its own
visiv is software for playing and managing television from the internet. We do not supply any channels, movies, series, playlists or streams and do not sell access to them.
The content comes exclusively from your own source, for example an Xtream login or an M3U link from your provider. You are responsible for ensuring that you are legally allowed to use this source. We do not work with any IPTV provider and do not recommend any.
A visiv subscription is a licence for the software. It contains no content and no access to content.
3. Your visiv account
To use visiv, you need a free visiv account. You sign in with your email address and a code that we send you by email; there is no password. Keep access to your email address protected, because anyone who has it can sign in to your account.
You may open an account from the age of 16; younger people need their parents’ consent.
You can delete your account at any time in the app, or write to us at support@visiv.tv from your account’s email address to have it deleted. This does not cancel a running subscription in the store – you do that in the store (section 6).
4. The 7 days to try it out
After signing in with your account, you can use visiv with all features free of charge for 7 days, without payment details.
The free trial is available only once per device and per email address. Other devices in your account share the running free trial; they do not start a new one. How we check this is described in the privacy policy.
After the 7 days, nothing turns into a paid subscription automatically. Without a subscription, playback pauses; your sources, favourites, settings and recordings are kept. With a subscription, you can carry on immediately.
5. Subscriptions and prices
There is one version of visiv with all features – without tiers and without additional purchases. You choose between a monthly subscription (2,50 CHF per month) and a yearly subscription (20,00 CHF per year). In Switzerland, prices include VAT; in the store, the price for your country applies, with the taxes that apply there. A lifetime purchase (“lifetime”) is not offered.
There is one version of visiv with all features – without tiers and without additional purchases. You choose between a monthly subscription (2,49 $ per month) and a yearly subscription (19,99 $ per year). In Switzerland, prices include VAT; in the store, the price for your country applies, with the taxes that apply there. A lifetime purchase (“lifetime”) is not offered.
Purchases are made in the Microsoft Store. The price shown there and the currency of your country apply.
Subscriptions renew automatically for the same term until you cancel them.
6. Payment, renewal and cancellation
Payment, renewal and cancellation are handled by the Microsoft Store. That is also where you manage your subscription (account.microsoft.com/services); visiv shows you the way there.
You can cancel at any time with effect from the end of the current term. Until then, your subscription remains active. Cancellation stops the next renewal; there is no pro rata refund for the current term, unless the law or the store provides otherwise.
There is no direct switch between monthly and yearly. If you want to switch, you cancel your subscription and take out the other one after it ends.
7. Refunds
Because all purchases are made through the store, refunds are decided by the store according to its rules. We ourselves cannot reverse any payments.
Mandatory consumer rights remain unaffected in any case. If you have any questions, our support will be happy to help.
8. Devices
With your account, you can use visiv on up to 5 devices. How many streams can run at the same time is determined by your provider, not by visiv.
If you want to sign in a sixth device, you first remove one of the five. You can do this in the app at most 3 times in 30 days; if you need more, our support will help.
visiv runs for up to 30 days without reaching our server. After that, the device needs to connect briefly so that visiv keeps running.
The subscription is intended for your private use. It may not be resold, rented out or shared with third parties beyond the 5 devices.
9. Right of use
For the duration of your free trial or subscription, we grant you a non-exclusive, non-transferable right to use visiv on your devices for private purposes.
visiv contains open-source components. They are subject to their own licences; you will find the details and the source code offer under “Licences and credits” and “Source code offer”.
10. What is not allowed
You may not use visiv to infringe the rights of third parties or to play content that you are not legally allowed to use. It is also not allowed to circumvent the device limit, the rules of the free trial or other security features, to resell the subscription or to misuse accounts, for example with disposable email addresses.
Reverse engineering, modifying or distributing the app is not allowed, unless expressly permitted by law or by an open-source licence.
In the event of serious or repeated violations, we may block your account or your subscription.
11. Third-party services
visiv works with third-party services, for example with the Microsoft Store for purchases and subscriptions, with your provider for streams and the TV guide, with Wikimedia for information on movies and people, and with YouTube when you open a trailer.
These services are subject to their own terms. They may change, fail or be restricted; we are not responsible for this.
12. Further development of visiv
We are continuously developing visiv. In the process, features, supported devices and system requirements may change. We make sure that the core of visiv – playing your own source – is preserved for the duration of your subscription.
We do not increase the price of a running subscription.
Should we discontinue visiv, we will announce this at least 30 days in advance in the app and by email. For periods that have already been paid for, the store’s rules apply.
13. Liability
visiv is carefully developed and tested. However, we cannot guarantee that the app will run at all times without interruption and without errors, or that it will work with every source.
We are not responsible for the content, availability and quality of your source. To the extent permitted by law, we exclude liability for slight negligence and for indirect damage. Liability for intent and gross negligence as well as mandatory statutory liability remain unaffected.
14. Data protection
How we handle your data is set out in our privacy policy. In short: your watch history, your sources and your favourites stay on your device. We only hold the data of your visiv account.
15. Changes to these Terms
We may amend these Terms, for example because of new features, platforms or legal requirements. We will announce material changes in advance in the app or by email. For a running subscription, they apply from the next renewal; if you do not agree, you can cancel beforehand.
16. Applicable law and place of jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention, CISG).
The place of jurisdiction is the registered office of nnexd GmbH. Mandatory places of jurisdiction for consumers are reserved.
